17th Liechtenstein Foundation Law Conference: «Legal Challenges in Foundation Structures»

On 2 December 2025, the Professorship of Company, Foundation and Trust Law hosted the 17th Liechtenstein Foundation Law Conference and welcomed around 120 participants to the Auditorium of the University of Liechtenstein. This year, recognised experts from Liechtenstein and abroad examined current legal challenges in foundation structures.


The conference programme was moderated by Prof. Dr. Alexandra Butterstein, LL.M. and Prof. Dr. Francesco A. Schurr, who emphasised the importance of this event in their opening addresses. Dialogue between academia and practice is more important than ever, particularly in light of the forthcoming revisions to foundation law and trust law. Each year, the Foundation Law Conference provides an excellent platform for constructive exchange and brings together representatives from various sectors in order to prepare Liechtenstein foundation law for future socio political developments in the competitive landscape of legal systems.
 

In keeping with established tradition, the Foundation Law Conference opened with a review of recent case law. Prof. Dr. Alexandra Butterstein, LL.M. discussed the most relevant judgments of the past year, which primarily addressed the tension between beneficiaries’ rights to information and the foundation’s interests in confidentiality. Dr. Albert Kaufmann then presented current developments from the perspective of the Foundation Supervisory Authority. In particular, the planned reforms of foundation law and trust law and their current legislative status were discussed. This was followed by an examination of relevant case law involving proceedings with the participation of STIFA.
 

Addressing current challenges in foundation organisation, Dr. Manuel Walser, LL.M., President of the Liechtenstein Bar Association, spoke about the legal position of beneficiaries of private interest foundations and their rights to information and disclosure. Univ. Prof. Dr. Johannes Zollner, Professor at the Institute of Corporate Law and International Business Law at Karl Franzens University Graz, examined the possibilities for amending beneficiary regulations. He focused in particular on the question of whether such amendments are equivalent to a change in the foundation purpose and therefore permissible only under more restrictive conditions. Building on these remarks, Prof. Dr. Francesco A. Schurr presented on the advantages and disadvantages, composition and competences of a supervisory body. When properly designed, such a body constitutes an effective instrument for sound Foundation Governance. From a comparative law perspective, Dr. Johannes Gasser, LL.M., Attorney at Law and Notary at Gasser Partner Rechtsanwälte, presented the practically significant “Anti Bartlett Clauses” and considered whether they are permissible under Liechtenstein foundation law or may even be introduced retrospectively for existing foundations. The subsequent panel discussion addressed whether and to what extent freedom of organisation in foundation structures represents a locational advantage for Liechtenstein.
 

Following the networking lunch, the traditional philanthropy segment of the Foundation Law Conference took place. As in previous years, this segment was organised in cooperation with the Association of Liechtenstein Charitable Foundations and Trusts (VLGST) and was opened with welcome remarks by its President, Dr. Thomas Zwiefelhofer. Dr. Theresa Gehringer reported on experiences relating to generational diversity within foundation boards and presented considerations for potential renewal and greater diversity. Prof. Dr. Marc Gottschald then presented, among other topics, the Philanthropy Report published by his Center for Philanthropy. This report represents the first comprehensive assessment of the sector in Liechtenstein and provides, for the first time, a systematic and scientifically grounded overview of the charitable foundation and association sector. The subsequent panel, chaired by Prof. Dr. Alexandra Butterstein, LL.M. and Prof. Dr. Francesco A. Schurr, discussed current challenges as well as new strategies and trends in philanthropy.
 

In the final thematic block on areas of tension and limits of private autonomy in foundation law, Hon. Prof. Dr. Georg Schima, M.B.L. HSG, LL.M. (Vaduz), Attorney at Law at conclusio schima lawyers, first examined possible solutions to prevent abusive, nominee and sham foundation structures. Dr. Vanessa Glaser, Attorney at Law and Partner at Glaser and Kleinsorge, then addressed the obligation to preserve capital in foundations from a comparative law perspective and discussed potential implications for Liechtenstein foundations. Current issues relating to arbitration in the foundation context were examined by Dr. Michael Nueber, LL.M., Attorney at Law and Public Notary at Nueber Konzett Rechtsanwälte. Finally, Dr. Marco Lettenbichler, LL.M., Assistant Professor, discussed whether and to what extent the founder’s freedom is restricted by recent case law of the European Court of Human Rights and the Austrian Supreme Court concerning protection against discrimination and the principle of equal treatment.
 

After a concluding round of questions, the 17th Liechtenstein Foundation Law Conference came to a close with a joint apéritif and exchange of ideas. Overall, the engaging and informative day demonstrated that the foundation landscape is undergoing constant change, while Liechtenstein foundation law remains sufficiently flexible to effectively address the challenges ahead.

As part of the FFF project “Breaking New Ground in Data-Driven Foresight” run by the Chair of Technology and Innovation in collaboration with the Fraunhofer Institute for Technological and Scientific Trend Analysis, a joint partner workshop was held at the Fraunhofer INT Institute in Euskirchen from November 26 to 28, 2025.

Niels Fetkenheuer, Clemens Armellini, and Marie Scheuffele from the University of Liechtenstein visited the project partner in Germany and were not only fascinated by the applied foresight research conducted by Fraunhofer INT, but also discussed joint research results, future cooperation opportunities, and ongoing cross-border collaboration.

After Dr. Marcus John and Melanie Martini from Fraunhofer INT visited the University of Liechtenstein last year, where the first joint partner workshop took place, this year saw a return invitation to Euskirchen, where the cooperation between the two project partners, which has now been in place for around two years, was further strengthened. The partner workshop kicked off with a research presentation by Melanie Martini (Fraunhofer INT, KATI Lab) and Marie Scheuffele (University of Liechtenstein, T&I Chair) on the topic of "Skills of the Future: What job postings reveal about AI skills" as part of the Fraunhofer INT public institute seminar. In their presentation, the speakers presented their current research on the use of online job posting data for data-driven foresight purposes and discussed the strengths and weaknesses of this innovative data source as well as its potential for the early detection of technology skill trends in the context of AI technology. Around 60 participants logged in online for the presentation, and the topic provided the perfect kick-off for the rest of the workshop agenda.

In addition to research-related discussions on data-driven foresight, data analysis, and tool applications, the agenda also included the creation of transfer opportunities, mutual support options, and collaboration in the MBA Technology and Innovation program. The overall outcome of the partner workshop was agreement that cooperation between the two organizations will continue and that joint paper submissions, new research project launches, and fresh teaching input are on the horizon. Ideally, the partner workshop will then enter its third round and the University of Liechtenstein will once again welcome Fraunhofer INT researchers to Vaduz.

After a six-year hiatus, the University of Liechtenstein celebrated the glamorous revival of its traditional university ball on Saturday, November 8, 2025. On the initiative of Rector Christian Frommelt, the event took place under the sparkling motto “Golden Nights, Sparkling Lights” in the ballroom of the Spoerry complex. The event was a complete success: all tickets had been sold out since the end of October, underscoring the excitement surrounding the comeback.

The hall was filled to capacity, bringing together the entire university family, consisting of 140 seated and 160 standing guests. The communal atmosphere attracted students, alumni, and staff, with some alumni traveling from Zurich and Munich especially for the event.

The charming and knowledgeable duo Sebastian Stöckl and Sophie Breitruck hosted the glamorous evening. Two bands from Vorarlberg provided the perfect musical accompaniment: first, the Swing Tonic Quartet presented dance music from the 1920s to the 1950s. Then the band Pastis, which stands for enjoyment and relaxation, thrilled the dance floor until the early hours of the morning.

The dance floor was opened with the traditional opening dance performed by seven student couples from almost all bachelor's and master's programs, choreographed by Iva Eberle from the Liechtenstein Dance Club. This was followed by a passionate dance performance by the Tango Liechtenstein association. At midnight sharp, the guests gathered for the traditional highlight, the midnight quadrille to Johann Strauss' “Die Fledermaus,” during which everyone present was invited to dance together.

Additional entertainment was provided by the casino of diamond sponsor Grand Casino Eschen in the adjoining room, where guests could play blackjack, poker, and roulette with play money. In addition, attractive prizes worth a total of up to 1,000 Swiss francs were raffled off. In addition to the three-course menu, guests were treated to burgers and fries from the food truck. The guests were enthusiastic about the revival of the ball and celebrated exuberantly until 3 a.m.

A big thank you goes to the moderator duo Sebastian Stöckl and Sophie Breitruck, as well as to the entire organization team, namely Carmen, Simone, Andreas, Daniel, and Janina, whose tireless efforts made this glamorous evening in the “Golden Nights & Sparkling Lights” possible.

The date for next year has already been set: The University Ball 2026 will take place on Saturday, October 17, 2026, once again at the Ballenlager.

First degrees in economic criminal law

The Executive Master of Laws (LL.M.) in Economic Criminal Law was launched in September 2023. The University of Liechtenstein has now awarded the first degrees to ten graduates of this innovative programme.

 

The LL.M. provides in-depth knowledge of Liechtenstein, EEA, European and international commercial criminal law, as well as Liechtenstein administrative and criminal procedure law.

 

‘The fight against white-collar crime, including cybercrime, is becoming increasingly important. Raising awareness of criminal law risks is more necessary than ever,’ emphasises programme director Prof. Dr. Konstantina Papathanasiou. ‘The LL.M. combines scientific principles with practical application and qualifies students for responsible roles in criminal defence, criminal prosecution, criminal compliance and crime prevention.’

This year's scholarship recipients, Noemi Pirrello from Italy and Johann Birnbaum from Germany, stood out in the application process thanks to their excellent academic achievements to date, their social commitment and their high level of motivation towards their fellow students.

The scholarship certificates were presented to the two students of the Master's programme in Innovative Finance just in time for the start of their studies by Elvira Knecht, Head of Human Resources Europe, and Selina Allemann, HR Expert Professional, as well as by representatives of the University of Liechtenstein, Prof. Dr. Martin Angerer, Director of Studies for the Master's programme in Innovative Finance, and Patrick Krause, Programme Manager for the Master's programme in Innovative Finance.

With the LGT University Scholarship, LGT supports promising young talent during their education by covering their semester fees for one academic year.

The Master's programme in Innovative Finance is an internationally recognised Master's programme and is currently one of the few English-language programmes in the German-speaking world focusing on asset and wealth management and international finance, which can be completed on both a full-time and part-time basis.

On Thursday, 18 September, nearly 90 students, staff, alumni and guests from Liechtenstein and the surrounding region braved the glorious sunshine to attend Barbara Ruech’s lecture at the University of Liechtenstein’s Atelier.

After an introduction by architect and lecturer Alberto Alessi, Barbara Lydia Ruech spoke under the title “The Japanese House and its Life as my Master” about her journey through rural Japan. Since 2023, she has been living and working there alongside Japanese craftsmen and architects to restore traditional houses in abandoned mountain villages. She encouraged the mixed-age audience to pursue their dreams.

Barbara Lydia Ruech, alumna of the Master’s programme in Architecture and lecturer at the University of Liechtenstein, combines architecture, photography and storytelling into a distinctive creative form shaped by craft traditions, respect for materials and a love of simple living.

 

Valuable Exchange

Following the lecture, she answered questions from the inspired audience about her life of deliberate simplicity, marked by unexpected encounters and meaningful collaborations. In a small accompanying exhibition, visitors were able to discover Japanese tools and sketchbooks and take part in a prize draw for authentic Japanese tea.

The evening concluded with lively conversations over Japanese beer, tea and rice crackers in the cosy atmosphere of the Architecture Atelier.

As part of the collaboration between the Liechtenstein School of Architecture and Alumni Relations, the University regularly invites alumni to share their experiences and expertise. The next Alumni Talk is scheduled for the end of the semester.

 

More about Barbara Ruech

Raised in a mountain village in Tyrol as the daughter of a craftsman’s family, Barbara learnt early on the value of precision and the magic of good stories. After training in furniture design and carpentry at the HTL Imst, she studied architecture at the University of Liechtenstein and spent an exchange semester in Bergen (NO). Her time with Peter Zumthor (CH) and renowned firms in Vorarlberg deepened her sense for atmosphere and craftsmanship.

Since 2023, she has been spending much of her time in Japan, immersing herself in traditional crafts and leading her research project “The Japanese House and its Life as my Master”. Today, she commutes between Dornbirn and the Japanese countryside, renovating historic houses, documenting encounters with her camera, and at times living in a small car that serves as both studio and home.

Since 2025, she has co-led the Foundation Studio for Built Heritage & Upcycling at the University of Liechtenstein together with Alberto Alessi. Her work invites us to value what already exists, use resources mindfully, and give space to stories.

At the graduation ceremony of the University of Liechtenstein on Friday, March 21, 2025, two doctoral degrees were conferred, and 30 graduates of the University of Liechtenstein were awarded their diplomas. In addition, six graduates received awards for outstanding achievements.

 

In his welcome address, Rector Dr. Christian Frommelt emphasized: “With your successful graduation, you have proven that you can adapt to various challenges and deliver excellent performance. With your resilience, you are well equipped to find your path in our fast-paced world, whether you choose to pursue an academic career or work in a company in the future.”

Doctoral Degrees in Economics

 

At this year’s graduation ceremony, two students in the field of Economics were awarded their doctoral degrees:

Amandine Herbé was awarded her doctoral degree with the distinction summa cum laude for her dissertation “How to improve both supply chain resilience and sustainability? An Information Systems perspective.” Her supervisor was Prof. Dr. Jan vom Brocke.

Kasem Zotkaj was awarded his doctoral degree with the distinction magna cum laude for his dissertation “Sustainable Taxation.” His supervisor was Prof. Dr. Martin Wenz.

Awards in the field of Architecture

 

The LIA, the Liechtenstein Association of Engineers and Architects, traditionally honors the top graduates of the Bachelor’s and Master’s programs in Architecture. The award for the Bachelor’s program went to Luis Friedemann, while the award for the Master’s program was given to Edwin Juerg Baertschi.

Awards for Economics

 

The “Promotion of Young Technical Talent” Foundation of Hilti AG once again honored the most innovative theses from the Bachelor’s and Master’s programs in Economics. The award in the Bachelor’s program in Business Administration was presented to Laura Boltizar. The prize in the Master’s program category went to Ermal Gashi (Finance program).

The Liechtenstein Bankers Association (LBV) traditionally awards prizes for the highest overall average across all modules in the Bachelor’s program with a specialization in Financial Services (IFS) and in the Master’s program in Finance. The award in the Bachelor’s program was presented to Natalie Galli, while the award in the Master’s program went to Ermal Gashi. In addition, the LBV grants a prize for outstanding academic and practice-relevant theses. The award in the Bachelor’s program in Business Administration with a specialization in Financial Services (IFS) was given to Natalie Galli. The prize in the Master’s program in Finance was awarded to Mykola Subtelnyi.

Five doctorates were awarded at the University of Liechtenstein's graduation ceremony on Friday, 27 September 2024, and 116 graduates of the University of Liechtenstein received their diplomas. Awards for outstanding achievements were also presented to nine graduates.

 

The Rector of the University, Dr Christian Frommelt, and the respective programme directors awarded the graduates their academic degrees in the fields of architecture and economics. The diplomas in MBA Technology and Innovation were presented by Prof Dr Leo Brecht and Dr Christian Frommelt.

In his welcome speech, Christian Frommelt emphasised: «Those who focus on diversity and flexibility benefit in many ways in our fast-moving world. The University of Liechtenstein has not only equipped you with cutting-edge expertise, but has also provided you with the soft skills that will give you the best possible start to your future thanks to its manageable and personalised structure.»

The award in the Bachelor's programme went to Dominik Sidler. In the Master's programme, the award was presented to Julian Hanser.
The LBV also honours outstanding academic and practically relevant theses.
Benjamin Kuchelmair received the award in the Bachelor's programme and Oliver Nägele received the award in the Master's programme.

CIT Coin Invest AG honours the best average of all modules (incl. Master's thesis) in the Master's degree programme in Entrepreneurship & Management. The award went to Bettina Beutner.

Simon Liegl was awarded a doctorate summa cum laude for his dissertation «Defining the Ill-defined - Exploring the Behavioural Underpinnings of Charismatic Leadership», his supervisor was Prof. Dr Marco Furtner.

 

Arabella Nigg-Stock was awarded a doctorate with the grade summa cum laude for her dissertation «Identifying patterns of innovation-efficient firms: Practices, processes and techniques», her supervisor was Prof Dr Leo Brecht.

 

Sebastian Moder was awarded a doctorate summa cum laude for his dissertation «Mindfulness in Organisations», his supervisor was Prof. Dr Marco Furtner.

 

Tian Luan was awarded the doctorate magna cum laude for his dissertation «CSR Decoupling, Corporate Governance and Green Investments», his supervisor was Prof Dr Marco Menichetti.
