New Schools of Thought (NeST) - Architectural education in times of homogenisation

Project Description

The research project NeST (New Schools of Thought) investigates tendencies in the context of academic homogenisation within European architectural education. It defines a new school of thought as a set of ideas and opinions on new methods of knowledge creation and on new forms of knowledge transfer, that a group of people dedicated to architectural design and spatial planning share about architectural education. Even though there is evidence of their emergence since the 1980s in Europe, there is a lack of understanding of the concepts that characterise these new schools of thought and the tendencies that drive them.

Since the late 20th century architectural education in Europe has been reshaped by key factors such as new policy regulations, internationalisation, social and climatic transformation processes, and digitalisation. This context has led to the emergence of a few trends in architectural education, which NeST identified as (1) a common need to close the gap between (a) academia and practice, (b) public awareness and financial support, and (c) architectural practice and pedagogical education; (2) the inability to find a language for architecture; (3) scientfication and digitalisation weakening the quality of architecture as physical and embodied matter; (4) scientification; and (5) commercialisation.

Within these tendencies architectural institutions have been seeking ways to differentiate themselves from the masses through content, methods of knowledge creation and transfer, and shifts in organisational structure. However, schools are no longer the only privileged place for thinking. New sites of knowledge production and reflection have arisen, giving way to new types of schools of thought. Besides (1) higher education, NeST also identified (2) secondary education, (3) research and (4) public mediation as expanded fields of architectural education.

Especially its environments are closely linked with the educational model and the character of a school of thought. These environments included, on the one hand, the physical environment (architecture, urban space), but also the socio-cultural environment in which the cases are operating, as well as the political and economic influences they are exposed to. In this phase, we questioned the impact of these environments on the educational model and thus the nature of a school of thought.

First findings show, on the one hand, that the environment influences the educational model of the school of thought and thus characterizes its nature (the educational model as a reaction to an environmental force). On the other hand, the schools of thought also use their surroundings deliberately to develop their educational model and thus the character of their school of thought (designing or making use of the environment for the educational model).

NeST identified especially four characteristics: (1) They embody freedom and independence, which they consciously use to promote autonomy and responsibility. (2) They think and act entrepreneurially in order to organise their (educational) projects and creatively use their environment. (3) They use strategic partnerships to teach and communicate interdisciplinarily and application-oriented. (4) They are processoriented and not result-oriented to promote creative processes.

The findings acquired by NeST during the two year course of research aim at, on the one hand, contributing to the contemporary academic discourse in architecture and, on the other hand, to the prerequisites for the formation of schools of thought.

New payment services in the European Union -opportunities and risks

Project Description

The Payment services Directive (PSD II) aims to regulate the variety of developments in the field of innovative payment products, in particular in the area of mobile and online payments. In addition, strong consumer protection rules were implemented.
The EU legislator has significantly expanded the personal scope of the Directive. Many of the providers currently operating outside the PSD 2 - (e.g. online trading platforms, technical service providers, etc.) - are covered in the Directive. This also applies to innovative internet service providers such as companies offering online banking-based payment initiation services.
Such services are regulated by PSD 2 for the purpose of consumer protection, which is why payment initiation services are considered to be providers of payment services from the date of application of PSD 2.
Such companies, like all other payment institutions, must have an appropriate license from the national supervisory authority before they can operate in the EU.
At that level, it is also clear that the economic and technical development in the area of payments services is moving away from traditional banking services.
The EU legislator has not only expanded the group of service providers subject to authorisation, but has also subjected these companies to numerous new behavioural obligations. These have a data-protection law component, a civil law component as well as several technical components.
To further investigate this topic, an interdisciplinary law-approach deems obligatory and has to cover both the "historical regime" by the PSD 1 and civil law aspects, as well as the GDPR to adress the strict Data protection law. Concerning the national law of Liechtenstein the soon to be expected ZDG (Zahlungsdienstegesetz) must be included in this research project. It's interdisciplinary approach aims at a better unterstanding of business models of payment services by examining supervisory law, civil law and business information systems (data security).

New is always better – On the sustainability of innovative firms

Project Description

The aspired project is meant to contribute to the research in the field of innovation and sustainability. Our intention hereby is to establish a direct impact of the innovation capability of a firm on its sustainability performance. Therefore, we will first collect and evaluate current literature regarding this topic before gathering data for our analysis. We will quantify a firm’s innovation capability by using a text-mining method to analyze the language and the usage of innovation-related words in a large body of financial analyst reports. The resulting measure will then, with a certain time-lag which is due to the deferred effects of innovation, be compared to the respective firm’s sustainability performance in the form of their Environmental, Social, and Governance (ESG) rating. Additionally, we want to examine whether there are different effects on the E-, S-, or G-pillar and if these effects are the same in different industries. We expect the innovation capability of a firm to have a significant positive effect on its sustainability performance, but we also expect this to vary regarding different pillars and industries. All our results are meant to be published in internationally renowned journals.

Publicly accessible "in-between" spaces within the urban landscape of Liechtenstein

Project Description

Like many European regions, the Alpine Rhine Valley is characterized by a heterogeneous mix of settlement areas, transport infrastructure, settlement-related open spaces, agricultural areas, and open landscape structures. The planning science tries to grasp this phenomenon of urbanization by different terms: agglomeration, urban landscape, urban area, intermediate city, sprawl town, etc.
The subject of this project is the undeveloped, publicly accessible "in-between" spaces within the urban landscape of Liechtenstein. The research project examines these on two different levels: (1) Everyday landscapes: In-between spaces are examined from the perspective of perception and use. (2) Conceptual landscapes: In-between spaces are viewed from the rational perspective of planning, systematizing, and controlling. The hypothesis is that there is little aesthetic attention for these in-between spaces in science, planning policy, and practice. The following three research questions are examined:
(1) Which types of everyday in-between spaces are there in Liechtenstein?
(2) How are the in-between spaces of Liechtenstein perceived and used by various actors in their daily life, for economic and agricultural use, in the planning policy, for nature conservation, etc.?
(3) How can the perception-oriented perspective of everyday landscapes be brought into institutionalized processes of conceptual landscapes?

New concept for financial market law in Liechtenstein

Project Description

In October 2020, the Liechtenstein government launched an ambitious legislative project. By January 1st 2025, a new banking and financial markets law shall enter into force and align the legal framework with the latest European legal requirements. The reorganisation of Liechtenstein's financial market law is one of the most important legislative projects of recent years. It raises several legal questions that will be comprehensively analysed as part of the research project.

The primary focus of the legislative project is the Banking Act (Bankengesetz - BankG), the original version of which dates back to 1992. The provisions on prudential requirements of investment firms, the provision of investment services and investment activities as well as the rules on trading venues will be transferred to independent special laws and the Banking Act will be comprehensively reformed. At the same time, the new laws serve to implement current EEA legislation. The project aims at significantly reducing the complexity of banking and financial markets law in Liechtenstein in order to make it more accessible to market participants.
The research project will analyse, among other things, what specific changes the reform holds for market participants and how the new financial markets law fits into the European legal framework. Against this background, the reform project will also be analysed from a comparative law perspective, with the Austrian implementation in particular being used as a benchmark.

Relevance to Liechtenstein

The Liechtenstein financial market is of central economic and social importance for the country. A coherent, clear and user-friendly financial market law is the basis for competitiveness and further development of the financial sector and the economy. It is also a prerequisite for implementing innovations in the areas of digitalization and sustainability. At the same time, financial market law is heavily influenced by the increasing number of EEA legal acts, which are being amended at an ever-increasing pace. With the reorganisation of the financial market law, the legislator aims to adapt the legal framework to new European legal requirements and simplify it at the same time.

The scientific review of the comprehensive revision can make a significant contribution to increasing legal certainty in Liechtenstein and ensuring that European and national regulations interact frictionless. On the one hand, scientific guidance can support legislators in further improving the legal framework for future reforms and aligning it even better with the needs of market participants. On the other hand, the key results of the project will be presented in autumn 2024 at a symposium organized by the professorship (Liechtenstein Banking Law Forum) and discussed with companies and public institutions. This will provide practical guidance to entrepreneurs and companies. The objectives of the research project are in line with the government program 2021-2025, which provides for the continuous adaptation of the financial market law framework to the requirements of the market, taking into account international developments and enabling digital and sustainable innovations.

Scientific, Economic and Societal Impact

In recent years, the Liechtenstein financial market has grown strongly and has become a central pillar of the country's economy. As a result, financial market law is also of direct importance to more and more entrepreneurs and companies. With the reorganisation of Liechtenstein's financial market law, which is the subject of this research, the legislator intends to align the legal framework more closely with EEA law and simplify it for legal practitioners. To this end, the Liechtenstein legal framework is being thoroughly revised.

The enactment of a new legal framework is, however, accompanied by novel legal questions. The scientific review of the legislative project as part of the research promotes legal clarity and legal certainty in Liechtenstein. Discussions with companies and public institutions will also provide practical guidance for the interpretation and application of the new provisions. The research results will be made available to legal practitioners in the form of a conference (Liechtenstein Banking Law Forum) and a conference volume.

Secondary School in Kenya

Project Description

The Liechtenstein Fumathoka Foundation (fumathoka.li) has been running a kindergarten and a primary school for needy children and orphans from the Mombasa region in Kenya already for more than 15 years. Currently around 500 children are taught and managed by 38 employees in Majaoni.
The project studio task is to design a secondary school for up to 240 pupils and about 40 employees including an attached boarding school in Kikambala, Kenya (about 1 hour north of Mombasa). The spatial program includes many functions like classrooms, sleeping rooms, office spaces, kitchen and sanitary facilities, assembly hall, sport venues, religious buildings, staff apartment’s, agricultural buildings and many more.
The site has more than 50.000m2 and additionally to the secondary school a self-sufficient agriculture with fruit growing, arable farming and animal husbandry is planned. Our main material and construction processes will be rammed earth – we will work very closely with Martin Rauch and his team. Circular construction, sustainability and energy neutrality are an integral part of the project studio. The opening of the secondary school is planned for 2023.

Network of Excellence GARNET: Management of Collaborative Research Processes

Project Description

Relevance to Liechtenstein
